Informed Consent and Waiver of Liability
Rules of Participation
I wish to participate in the live animal activities (the “Animal Activities”) through Mobile Adventures, LLC dba The Wild Thing. To help me safely participate in the activities, I agree to each of the following requirements:
• I acknowledge that there is a significant element of risk involved with the Animal Activities. Although The Wild Thing will take reasonable steps to provide a safe environment, animals may bite, peck, scratch, sting, or otherwise injure me or someone else. I recognize that animals may behave unpredictably in reaction to noises, light, sudden movement, unfamiliar persons or environments, or other unusual conditions.
• I understand that physical activity involving animals carries the risk of harm and injury. I understand that in handling and being in the presence of animals, I may be at risk of injury including physical harm caused by the animals or transmission of disease.
• I knowingly and voluntarily assume all risks and hazards incidental to the Animal Activities.
COVID 19 Assumption of the Risks and Release
• I recognize that there are certain inherent risks associated with the above described activity
Regarding COVID-19, acknowledge the contagious nature of COVID-19 and understand that CDC and public health authorities recommend the practice of social distancing, and I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge Mobile Adventures LLC for injury, loss or damage arising out of my or my family's use of or presence upon the facilities of Mobile Adventures LLC, whether caused by the fault of myself, my family, Mobile Adventures LLC or other third parties.
• I agree to follow all guidelines and any directions given by the staff of The Wild Thing.
• I acknowledge that Mobile Adventures LLC cannot guarantee that I will not become
infected with COVID-19.
Indemnity Agreement
To the fullest extent allowed by the law, I agree to indemnify, defend, and hold The Wild Thing, {:14} and {:37} harmless for all bodily injury, personal injury, illness, property damage or other losses (including attorneys’ fees and costs of litigation), that result to me or anyone else because of my child or me participating in the Animal Activities. This indemnity obligation inures to the benefit of The Wild Thing, {:14} and {:14} harmless its insurance carriers, employees, representatives, assignees, officers, directors, members, and agents. This agreement to indemnify binds me, my spouse, heirs, executors, personal representatives, and assigns.
For Participants Over the Age of 18:
I have read this Informed Consent and Waiver of Liability, and understand its terms. I sign this Informed Consent and Waiver of Liability voluntarily and agree to be bound by its terms.
Participants Younger than Age 18:
I am the parent or legal guardian of (the “Minor”). I consent for the Minor to participate in the Animal Activities at The Wild Thing. I have read this Informed Consent and Waiver of Liability, and understand its terms. I sign this Informed Consent and Waiver of Liability voluntarily and agree to be bound by its terms.
